Senior Fellow Ava Morgenstern (2006 Amsterdam) published an article in the Michigan Journal of International Law on “Asylum-Free Zones”. The article discusses parts of the United States in which asylum law is almost never honored, and that these courts are breaking international law as they are restricting the rights of refugees to fair hearings. The article suggests intervention by an international body and explains that appeals solve the issue only on a case-by-case basis, but do not fight the systematic disparities.
In fixing the issues, Ava suggests: “In the long term, advocates will need to work for and wait for a future Presidential administration and a future Congress that will strengthen the capacity of the EOIR, DHS, and State to adhere to the U.S. and international human rights obligations to persons fleeing persecution.”
